1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern the provision of services by Psyche2Psyche, a trading name of Psyche Global Movement (“we,” “us,” “our,” or “Psyche2Psyche”), directly to our clients (“you,” “client”). By scheduling, booking, or using our services, you acknowledge and explicitly confirm that you have read, fully understood, and agree to be legally bound by these Terms. Psyche2Psyche reserves the right to modify or update these Terms at any time. All changes will be published on our official website, and it remains your responsibility to regularly review these Terms. Continued use of our platform after any changes constitutes your explicit acceptance of the updated Terms.

2. Scope of Services

Psyche2Psyche provides non-clinical mental health support services, which include:

  • Mental Health Mentoring
  • Peer-to-Peer Support
  • Mental Health Advocacy
  • Guidance on reporting mental health malpractice, including detailed steps for submitting complaints to relevant regulatory bodies and contacting human rights organizations.

These services are provided exclusively by Psyche2Psyche’s authorized representatives through scheduled 20-minute Zoom sessions. Services provided are purely informational and advocacy-focused.

3. Non-Therapeutic Nature of Services

Psyche2Psyche’s services are not a substitute for professional therapy, psychological counseling, psychiatric evaluation, medical treatment, or legal advice. Psyche2Psyche does not offer any clinical diagnoses, therapeutic treatments, counseling, medical interventions, or legal representation. Representatives of Psyche2Psyche are not licensed mental health professionals, lawyers, or medical practitioners. All information and advice provided is for informational purposes only and should not replace professional medical, psychological, or legal advice.

4. Intellectual Property Rights and Restrictions

All content, including but not limited to text, videos, images, logos, graphics, and any related materials provided through Psyche2Psyche’s website or services, remains the intellectual property of Psyche Global Movement. Any unauthorized use, reproduction, distribution, modification, or attempt to replicate, plagiarize, or otherwise infringe upon Psyche2Psyche’s intellectual property will result in immediate legal action. Legal remedies shall be pursued to the fullest extent permitted by law against any party infringing on our intellectual property rights.

5. Data Security and Malware Disclaimer

While Psyche2Psyche employs reasonable security measures, we make no warranty against viruses, malware, or harmful code that may affect users. By accessing our platform, you accept the risk associated with internet-based interactions and agree to maintain updated antivirus software and exercise due diligence.

6. No Guarantee of Immediate Support

We offer services based on availability and operational capacity. Psyche2Psyche does not guarantee immediate responses or urgent support, and our response times may vary. Clients acknowledge that sessions must be pre-scheduled and that Psyche2Psyche cannot guarantee real-time or emergency support.

6. Payments, Cancellations, and Refund Policy

Full payment for paid services is required in advance. Cancellations or rescheduling must be communicated at least 24 hours prior to the scheduled session. Failure to provide timely notification may result in the forfeiture of your fee. Refund requests are evaluated individually. Payments are generally non-refundable, except if Psyche2Psyche cancels the scheduled session. Refund or rescheduling due to technical difficulties or platform issues will be considered solely at Psyche2Psyche’s discretion.

7. Conduct of Psyche2Psyche Representatives

All Psyche2Psyche representatives must conduct themselves professionally, respectfully, and ethically. If you experience any inappropriate behavior or misconduct from a representative, please report it immediately via email at [email protected]. Psyche2Psyche will promptly investigate and address all such reports confidentially and appropriately.

8. Client Responsibilities and Liabilities

Clients are required to provide accurate and complete information for the effective provision of services. Clients assume full responsibility for the implementation of any advice, recommendations, or information provided by Psyche2Psyche. Clients explicitly acknowledge that outcomes depend on various external factors beyond Psyche2Psyche’s control.

8. Indemnification and Limitation of Liability

By using Psyche2Psyche services, you agree to indemnify, defend, and hold harmless Psyche2Psyche, Psyche Global Movement, its officers, directors, representatives, and affiliates from and against any claims, actions, liabilities, damages, losses, costs, and legal fees resulting from or related to your use or misuse of provided information, breach of these Terms, or any actions you take based upon guidance provided.

Under no circumstances shall Psyche2Psyche, its representatives, or affiliates be liable for any direct, indirect, incidental, consequential, punitive, exemplary, or special damages arising from your use or reliance upon our services or information provided. Clients assume full responsibility for all decisions and actions resulting from service engagement.

9. Emergency Services Disclaimer

Psyche2Psyche is NOT an emergency service provider. If you are experiencing a mental health crisis or emergency, please contact your local emergency services immediately. Psyche2Psyche cannot provide crisis or emergency assistance, immediate intervention, or urgent clinical care.

9. Defamation and Reputation Protection

You explicitly agree not to publish, share, or disseminate defamatory, malicious, misleading, or harmful statements about Psyche2Psyche, its representatives, or Psyche Global Movement. Any false statements intended to damage the reputation or integrity of Psyche2Psyche or its personnel may result in immediate legal action and pursuit of damages to the fullest extent permissible under applicable law.

10. Force Majeure

Psyche2Psyche is not liable for delays, interruptions, or failure of service delivery caused by events beyond its reasonable control (“Force Majeure”), including but not limited to pandemics, natural disasters, strikes, government actions, or technical interruptions. In such circumstances, we will make reasonable efforts to resume services promptly.

10. Governing Law and Jurisdiction

These Terms shall be governed by, interpreted, and enforced in accordance with the laws of England and Wales. Should UK jurisdiction not apply, disputes will be resolved according to Sri Lankan law. Both parties agree to submit exclusively to the jurisdiction of courts in the United Kingdom or, if applicable, Sri Lanka.

11. Entire Agreement and Severability

These Terms constitute the entire agreement between you and Psyche Global Movement concerning the use of Psyche2Psyche’s services and supersede all prior agreements, understandings, or representations. Should any provision of these Terms be found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

11. Cookies and Tracking Technologies

Our platform employs cookies and tracking technologies, such as Google Analytics, to improve user experience, monitor website performance, and optimize our services. You can manage or disable cookies through your browser; however, disabling them may impact site functionality.

12. Intellectual Property and Copyright Notice

All material provided through our services remains the intellectual property of Psyche Global Movement. Unauthorized use, duplication, or distribution without prior written consent is prohibited.

12. Force Majeure Clause Confirmation

We explicitly confirm the applicability of the Force Majeure clause detailed in these Terms, releasing Psyche2Psyche from liabilities resulting from uncontrollable disruptions or delays.
